Rights and Responsibilities of Unmarried Parents

Mothers : If you are pregnant, considering becoming pregnant, or have had a child by a man who is not your husband, you should be aware of significant obligations you will have when you bring your child into the world. The father of your child will have the right to custody and companionship of the child, just as you will. The California child support Guideline formula will create an obligation for both parents to pay support for your child, based on the financial abilities of each and the amount of time your child spends with each parent. Even though you are not married to the father of your child, you will find yourself in a long-term relationship with him, as a result of having a child together. If you are unsure of whether you will be able to have such a continuing relationship with the father, you should give serious consideration to your options early in your pregnancy or before your child is born.

Fathers : If a woman you have had sexual relations with bears your child, you have the right to have a father-child relationship with your child. This means that you have rights to custody and visitation, as well as the responsibilities of providing financial support to your child. Both parents : If the mother wishes to place the child for adoption, she must obtain the consent of the child's father. Arranging an adoption without the consent of the father can lead to heartbreak and expense for many people - the father, the prospective adoptive parents, and the child. The mature and responsible path will involve discussions or counseling between the parents, and decisions that both birth parents can live with. Consideration of "open adoption" is one option.
